Is the Internet sales tax a way to get revenue? Of course it is, but…the issues seem to be a little more complex then people would like. Be it known, the Internet tax has been debated for years, but since the “great recession” and than the search for additional revenue by states, the issue is once again in the forefront. This, as you all know, came to a head when California signed into a law that required all online retailing sites to pay taxes on their affiliate sales, and it brought Amazon into the picture. Whom, as it has done in other states, cut their affiliate programs in the state of California.

Many affiliates in the state lost from 40 to 70% of their revenue. And, because of this lost, some moved their business to friendlier states. If you step back and look at the situation in California, you realized that is was really a lose-lose situation for both Amazon and for California.

Don’t think so. In my estimation California would gain Internet sales tax revenue, but instantly lost revenue from the affiliates that did or are doing business in the state. And, if the individuals or small businesses move elsewhere, that is more lost revenue.

Amazon, is losing affiliates from every state that decides to collect revenue from the Internet. Surely they can’t be happy about this either. This, I suppose, is why Amazon reached an agreement with California to approach Congress about addressing Internet sales taxes. If not tax solution is found, than California would once again but the tax into place. But in California’s and the Amazon affiliate issue, the case is rather mote, since Amazon is planning on putting physical call centers into the state.

When you think about it, this issue is really interesting. Why? States normally impose taxes that are usually local or state wide. In the case of Internet taxes, it’s going across state borders and is truly “interstate” in nature. Not, that they can’t legally do it, but they can.

Bills in Congress and Senate

There is currently several bills before Congress.

  • Before the Senate-Main Street Fairness Act- This bill calls for a set of federal guidelines that would dictate how states could collect sales taxes from online retailers.
  • Before the House-Marketplace Equity Act of 2011-This bill is a little different from the Senate. This bill gives states the authority to require retailers, online and offline, the authority to collect sales taxes even if the customers are located in states where the companies have no physical presence.

Bottomline, both bills are trying to find ways to give the states the authority to have a state-based system of taxation on the Internet.

Internet State Options Suggested
 
There has been suggestions to possible options that can make the Internet tax a little more uniform.

Some have suggested 1) nationwide sales tax in which a certain portion of the income would be given to all the states, or 2) the current idea of taxing consumers at the origin of sale and not at the destination.

The problem I see, is uniformity because overall, local taxes within the states are not uniform. A national tax would bring uniformity. Question is, but would the federal government distribute the revenue to the states?

And as to the current idea of taxing consumers at the origin, if can be a major headache for online retailers if they have to comply with a different tax from each state.

To conclude, states are definitely looking to the Internet to help solve their budget shortfalls, however, I see a little chaos before the calm before it’s all said and done.

I’ve seen some people suggest to newbies that to get good results they should buy and create a domain that has the name of the affiliate product that they going to promote. When I read this, my internal warning mechanisms kicked in.

If you heeded this suggestion, you are in fact, violating the terms of that company. All companies  have affiliate programs rules which prohibit this type of behavior.

Remember, the company affiliate rules are there for a purpose. And it is not to protect you, but to protect the company’s brand. Thus, if you violate this rule, the company can legally suspend your commission and not pay you for what commissions you have earned due to the violation.

Finally, this tactic can ruin your reputation online. My thought, it’s not worth it, if you truly want a business online.

Affiliate Marketing in the New Year

If you’re new to affiliate marketing, you may not be fully aware of the changes that affiliate marketing has seen.  I’ve been on the Internet for a little over 5 years and I’ve seen some subtle changes in the affiliate marketing business. These changes are due mainly through government intervention.

When the FTC put rules into affect for bloggers, it also affected affiliate marketers. Let me explain:

1) The FTC states that if a marketer gives a product to a blogger to review for free, the blogger must disclose that he/she is reviewing the product and has been compensated in some form.

This rule can affect an affiliate marketer, because if they purchase the product because of your online review, you are being compensated.

2) Word-of-mouth campaigns. Sometimes a company will ask an individual to send out emails to friends, and in return they will receive something of value.

3) Testimonial-I’ve used testimonials when I have used the product and liked it. However, you will have to state if your testimonial is “not typical” for most consumers.

Sometimes people use testimonials. However, some may have not used the product and their reviews are totally hyped selling. This caused some people to be scammed or greatly disappointed with what they bought. But with new rules in place, this game can find both the advertiser and the individual who is hyping the product a lot poorer.

4) Expert Endorsement must be from an expert. Anybody can attach expert to their credits, but in the eyes of the FTC the expert needs to have special knowledge that qualifies him or her to make that expert distinction.

The FTC knows the online community rather well. I’m sure they assumed some people will ignore their rules so with the rules come the penalties. And they can be steep if they are ignored, especially if you’re given a first warning.

After the first warning, you can be fined $11,000 for each infraction. This fine can be levied against the advertiser and the blogger.

That last bold sentence above tells you about the affiliate marketing business. It has been forced to grow up. If  the advertiser, the blogger, or the affiliate marketer does not play by the rules of business, expect the penalties.

Why is this happening? The 21st century is now seeing more and more people going to the Internet to buy and to be social. By imposing rules, it protects the consumer from advertiser and/or affiliate marketer that does not want to play by fair rules of business.

These rules should not be feared but should be applauded. Why? I my eyes affiliate marketing is becoming more legitimate through this simple government intervention.

Will there be more twist and turns in the new year? Maybe. Let’s think about this. With the states hurting for revenue, I am wondering if more states will jump to the Internet for revenue by way of state sales tax. Now, if the majority of the states begin this practice, Amazon will be hard pressed to try and stop doing business with people from those states. They would lose more revenue than they would gain.

To conclude, I found the old year, and the changes on the Internet, rather interesting. But with the new year upon us, I do not believe for a minute that my work environment, the Internet, will remain static, but will see more changes. What do you think?

Your Bottom Line and Affiliate Marketing

Ah yes, affiliate marketing can help your bottom line (money wise). However, if you choose the wrong affiliate program you may find yourself with the gift that keeps giving for the advertiser.

Through trial and error and some frustration I’ve learned never to assume and to always get it in writing. If you don’t heed my warning, you may find yourself penniless. I’ve found the “stand alone” affiliate program the type of program that you have to truly do your true diligence. And never, never, assume you will be paid for a product or service within an affiliate program unless it is stated or you get clarification. I one of my own weak moments I partook in an affiliate program that  matched my site. I placed the links up on my site that was in their products page, assuming that I would be paid for these little gems, I put them on my site. Behold, I made four sales and I received a single digit payout. What did the advertiser get- let’s just say four figures.

Most people have a vague idea what affiliate marketing. And the most obvious is that affiliate marketing allows you to make income from other companies and other people’s products without having a product yourself.

And yes, there is more than one way in which you can make your income through affiliate programs. Not all the payment methods are created equal, as you will see. Each method is dependent upon your skill level and your time online.

Affiliate Marketing and Google? I thought I would begin with a question, when it comes to affiliate marketing and Google. And yes, Google is now moving into Affiliate Marketing.

Their affiliate site is called “Google Affiliate Network”. Since I am an affiliate marketer, I could not resist the temptation to see what Google has to offer, so I signed up.

The Google Affiliate Network is relatively new, thus, they are still growing. The site, like the other affiliate brokerage firms, offer different categories- from apparels to wine spirits. However, I’ve noticed that they offer something slightly different from the other affiliate brokerage firms. The company profile?

The company profile can be seen only when you click on the advertiser link that you would like to sell for or you’re interested in. By clicking on their link, you get an immediate view  the company’s profile. Which, I find very interesting. Why? Because they offer the following breakout of the company: Traffic Statistics by Country, Gender, Education, Age, Household Income, Audience Interests, and Sites Visited by their visitors. Why is this important? It helps you to match your site to the advertisers.

The other links include Advertiser information, Commission and Guidelines. Within the advertiser information, you’ll find a synopsis of what the Advertiser is all about, including commissions and guidelines for the program. (You can then go into the other tabs, Commissions and Advertisers Terms to get a complete picture of the company’s offer and restrictions.) I would definitely look at the Advertisers Terms, because that will give you the does and don’ts of their program. If the company rules are not followed, they can deactivate you and pull back your commissions.

To conclude, for those in affiliate marketing, this is yet, another opportunity to look at for affiliate programs.

Affiliate Marketing can be one way in which you can have a business online. However, sometimes the expectations of those that enter into this business believe, falsely, that it is an easy business to begin. It’s

Do they use banner ads, text links, HTML code for newsletters, and do they have a wide variety of graphic ads? Also, make sure that they frequently update their ads as well. If they are still running Christmas ads in July, they might have difficulty managing their affiliate marketing department.

Always read through and understand the terms of payment to ensure that you choose marketing programs that are best suited for your needs. Every associate program offers its own payment structure and terms. Determine how you will be paid, as some programs pay on a weekly basis, while others pay on a monthly basis after you reach a set threshold. By taking these factors into consideration, you can make certain that you select the best affiliate programs for your needs.
